Mandate in Case of Incapacity

An incapacity mandate allows you, while still of sound mind, to designate a person who will see to your welfare and affairs if you become unable to do so because of illness, an impairment, age-related deterioration or an accident.
There are two types of mandate:
- a notarial mandate
- a mandate signed before witness
No specific form is needed to draw up a mandate. However, a sample form is included with the brochure "My Mandate in Case of Incapacity", prepared by the Curateur public du Québec.
